Welcome to Your Photos. We sincerely hope you enjoy your time spent with us and find that using our service is easy and fun.

These Terms of Service describe the way in which you (the "Member") may use the Your Photos service, and the way in which Your Photos will operate the service. In this Agreement, Your Photos means YourPhotos.com service, Your Photos, Inc., its subsidiaries that participate in offering the service, or its agents, employees, contractors, or others authorized by Your Photos, Inc.

Modifications/Changes to Agreement and Service

YourPhotos.com may change the Terms of Service at any time. For updated Terms, please refer to this site occasionally for any changes. By accessing the service after a notice of a change has been published, you are agreeing to be bound by the change. YourPhotos.com may discontinue or revise any or all other aspects of the service at its sole discretion and without prior notice.

Rules for Online Conduct

  • Members warrant they shall not use the YourPhotos.com service for any of the following activities:
  • Displaying photos that contain nudity or pornographic material of any kind;
  • Posting, photos, captions, names, posts or descriptions that convey blatant expressions of bigotry, prejudice, racism, hatred or profanity;
  • Defaming any person or group;
  • Linking to any site that promotes any of the above;
  • Uploading material containing any virus or other content that may damage the service, the network, or any other user's equipment or software;
  • Violates any laws, rules, or regulations of any governmental or other administrative organization having authority over the service, or users.
  • Impersonates another Member, a YourPhotos.com employee, law enforcement officer, community or religious leader, or school teacher;
  • Espouses, supports or criticizes a particular viewpoint;
  • Contains information intended to assist in the placement of a bet or wager;
  • Facilitates the delivery of "spam" e-mail;

YourPhotos.com reserves the right to remove, at its discretion and without notice, any material contrary to these policies and/or to refuse service to anyone who violates any of these Terms of Service. Although YourPhotos.com takes reasonable precautions to preserve and protect the material you may upload to the service, YourPhotos.com cannot warrant that no loss or corruption of data shall occur. You should not rely on the service as your only source for the material you provide. You should backup copies of any digital information you have uploaded to YourPhotos.com.

Use of Services

Member is responsible for all users who access the service using the member name. Member must notify YourPhotos.com promptly by e-mail regarding the theft or loss of any member name or password. You acknowledge and agree that any submission may be published, copied, customized, removed, transmitted and shown by Your Photos for the purposes of delivering the Services. In addition, you warrant that all moral rights in any uploaded images and materials have been waived.

The electronic or physical sharing of your images and materials constitutes permission for reprinting by the recipient.

Your Photos will not be liable or legally responsible for the content of any submission.

Canceling the Service

Your Photos retains the right to cancel the Service, remove images in accounts or to discontinue accounts that have been idle for more than 60 days. We may do so at our sole discretion.

Copyright

Users retain all rights in any material uploaded to the service by the users. No copyrighted material may be placed on the service by anyone without the permission of the copyright owner, or persons authorized by the copyright owner to grant permission. You are responsible for obtaining the necessary permission before permitting any copyrighted material that belongs to others to be placed on the YourPhotos.com. You may download the material available on the service for your personal, non-commercial use. Except as may be permitted by the Copyright Law, you are responsible for obtaining permission before reusing any copyrighted material that is available on the service. It is the obligation of the individual members to ensure that no copyright is being violated by the posting of their photos. Members are solely responsible for the content of their photo albums.

Privacy

YourPhotos.com will not release any details regarding the member to any 3rd party, except as required by law. We will protect and only use this information as noted in our Privacy Policy.

Warranty

Member acknowledges that use of the YourPhotos.com service is at User's sole risk. The service is not warranted to be error free or uninterrupted, and there is no warranty as to the results obtained through use of the service. The service is provided on an AS IS basis. THERE ARE NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE WITH RESPECT TO THE SERVICE. Neither YourPhotos.com nor anyone else involved in creating, producing, or delivering the YourPhotos.com service, or any services accessible through the service, will be liable for any direct, incidental, special or consequential damages arising out of this Agreement. In no event will the liability of YourPhotos.com for any breach of this Agreement exceed the total charges incurred by a User in the month preceeding the date the claim for breach arose. The provisions of this Section will survive termination of this Agreement.

Indemnification

You agree to indemnify, defend and hold harmless YourPhotos.com or Your Photos, Inc. against all damages, claims, liability, costs, and expenses, including but not limited to reasonable attorneys fees, arising out of violation of any of the provisions of this Agreement by you or anyone accessing the service under your account.

Governing Law

All materials, software, information and other products supplied by or through our Service are provided with "RESTRICTED RIGHTS" use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in FAR52.22724 and DFAR252.227-7013 et seq. or its successor. Use of any of such by the Government constitutes acknowledgment of our or our suppliers' proprietary rights in them. In the event that the License, or any part thereof, is deemed inconsistent with the minimum rights identified in the Restricted Rights provisions, the minimum rights shall prevail.

Entire Agreement

The Member Agreement and these Terms of Service constitute the entire agreement (collectively "Agreement") between YourPhotos.com and Member with respect to the service and supersede all other communications.
